Please read these terms carefully before engaging our services. By enquiring about, instructing, or continuing to use the services of Somrak, you confirm that you have read, understood, and agree to the terms set out below. If anything is unclear, we are happy to explain before any engagement begins.

1. About Us

2. Scope of Services

We offer three levels of service for inheritance and estate matters:

The precise scope of each engagement will be confirmed in a written engagement letter before work commences.

3. Engagement and Instructions

Our professional relationship begins when we issue and you accept a written engagement letter, and where applicable, when the agreed fee or deposit has been received. We act on instructions provided by the named client only. Where multiple family members are involved, we will agree in writing who holds authority to instruct us on behalf of the matter.

4. Fees and Payment

4.1 Fee Structure

Fees for each service level are as stated in our engagement letter and on our website. All amounts are quoted in Thai Baht (฿) and are inclusive of VAT where applicable.

4.2 Payment Terms

For the Inheritance Overview, full payment is required before the session takes place. For Preparation & Filing Support and Full Matter Support, a deposit of 50% is required upon engagement, with the balance due upon completion or at agreed milestones. We will issue a formal invoice for each payment.

4.3 Additional Costs

Disbursements — such as court filing fees, government registration charges, notarisation, and translation costs — are payable separately and will be itemised and agreed with you before being incurred.

4.4 Late Payment

If a payment is not received by the agreed date, we reserve the right to pause work on your matter and, where necessary, to withdraw from the engagement following reasonable notice. We will not take any such step without first seeking to resolve the matter with you directly.

5. Cancellation and Changes

We understand circumstances change, particularly during difficult times. If you need to postpone or cancel an Inheritance Overview appointment, please give us at least 48 hours' notice to avoid the session fee being charged. For ongoing engagements, either party may bring the engagement to a close on reasonable written notice. We will charge only for work completed to that point, and will provide you with all documents relevant to your matter.

We treat all information shared with us as strictly confidential. We will not disclose your information to third parties except where necessary to carry out your instructions, where required by law or court order, or where you have given your consent. 8. Conflicts of Interest

We conduct conflict checks before accepting any new engagement. If a conflict of interest arises during your matter, we will inform you promptly and take appropriate steps, which may include referring you to independent legal advice.

9. Limitation of Liability

Our liability to you is limited to direct losses arising from our own negligence or breach of professional duty. We are not liable for losses arising from circumstances outside our reasonable control, including delays by courts, government bodies, or third parties, or from information you have provided that is incomplete or inaccurate. Nothing in these terms limits liability for fraud or for matters that cannot be excluded by law.

We take your experience seriously. If you have a concern about any aspect of our service, please contact us at [email protected]. We aim to acknowledge any complaint within two working days and to provide a substantive response within 14 days. If you are not satisfied with our response, you may refer the matter to the relevant Thai legal professional body.

11. Intellectual Property

All content on our website — including text, layout, and design — is owned by or licensed to Somrak. You may not reproduce or distribute any part of this website without our prior written consent. Documents and advice prepared specifically for your matter remain your property once all fees have been settled.

Our website is provided for general informational purposes only. Nothing on this site constitutes legal advice, and no solicitor-client relationship is created by visiting or using the site. We make reasonable efforts to keep information current but make no warranty as to its accuracy or completeness at any given time.

13. Governing Law

These terms and any engagement between us are governed by the laws of Thailand. Any dispute arising in connection with our services that cannot be resolved amicably shall be subject to the jurisdiction of the Thai courts.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. The current version will always be available on our website. We will notify active clients of any material changes by email. Continued engagement with our services following an update constitutes acceptance of the revised terms.
